What does your credit repair business actually provide?
Describe the paid service in language a reviewer can compare with your contract and website. Credit-report review, assistance disputing alleged inaccuracies, educational material and ongoing monitoring are different deliverables. If several are sold together, explain the package instead of assigning the entire business a convenient software or consulting label.
Identify who sells the service and how: your website, employees on calls, outside lead generators, affiliates or a combination. A customer completing payment online does not tell the whole story if a telephone sales process produced the sale. Explain the actual sequence so the appropriate legal and acquiring review can assess it.
A processing inquiry should also distinguish credit repair from debt settlement, lending, collections and credit-monitoring software. Support for one category does not establish support for the others. If you have several activities, describe their entities, websites and revenue separately. Do not hide a service behind a broader business description.
When can a credit repair fee be charged?
Two federal frameworks need separate attention. Under CROA, 15 U.S.C. 1679b(b), a credit repair organization cannot charge or receive consideration for an agreed service before that service is fully performed. The statute also prohibits deceptive representations. That is a substantive service-and-billing rule, not a rule that a processor can waive. U.S. Government Publishing Office: 15 U.S.C. 1679b: Prohibited practices
For covered telemarketing, the FTC explains an additional TSR restriction: the promised service period must have expired, and the consumer must receive a consumer report showing the promised improvement, issued more than six months after the results were achieved. It is not simply a six-month wait from enrollment or the first payment attempt. Have qualified counsel assess the actual sales process and applicable rules. Federal Trade Commission: Complying with the Telemarketing Sales Rule: payment restrictions on credit repair
A monthly subscription, setup fee, paid onboarding session or change from cards to bank debits does not answer whether a particular charge is permissible. Do not design billing around an assumed exception. Bring a plain description of the proposed fee trigger and the basis your business uses for determining that a charge is due. MerchantBridge does not certify a credit repair billing model.
What evidence connects the charge to the promised service?
Our suggested preparation is a short service map: the consumer agreement, the work promised, how completion is recorded, the point at which billing is enabled and how a cancellation stops future collection. This is a business-review aid, not a substitute for the documentation that law or a partner may require.
Keep the sales promise consistent with the fulfillment record. A record that staff sent a letter is not automatically evidence that every promise in the contract was fulfilled. A payment system should receive an approved instruction to collect; it should not determine legal completion solely because a calendar date has arrived.
The FTC describes CROA's written-contract and disclosure protections, while the CFPB explains the consumer's right to cancel within three business days without charge. Review the operative agreement and cancellation process with the responsible advisers. Avoid promises of a guaranteed score increase or removal of accurate, current negative information. How should recurring billing and customer support work?
If a recurring arrangement is legally appropriate for the actual service, describe the authorized amount or calculation, timing and termination process. Ask the prospective provider whether it supports that specific collection flow. A recurring-payment feature is a technical capability; it is not an opinion that recurring fees are lawful for your offer.
Separate a failed payment from a canceled service or a charge that was never due. Staff should be able to see why collection is allowed before retrying. Maintain a clear support route, recognizable billing name and a process for investigating an unfamiliar charge. These are recommended operating practices rather than a promise that they eliminate disputes.
For example, consider a hypothetical business changing its customer portal. Before transferring active billing records, it should distinguish completed and billable work from uncompleted work, canceled accounts and contested charges. The project is not finished when saved payment methods appear in the new system. The business must also preserve the correct next billing decision.
What should a merchant prepare before requesting review?
Start with this business-level checklist. Approximate figures and a concise description are sufficient for an initial inquiry; later requirements depend on the opportunity. Do not attach consumer credit reports, Social Security numbers, dispute files, identity documents or payment credentials.
- Your business name, website, operating location and states where customers are served.
- The exact paid services, including any bundled monitoring, education or other financial activity.
- How leads are generated and sales completed, including calls and outside marketers.
- The proposed fee trigger and whether billing is one-time, recurring or tied to defined work.
- A summary of contract, cancellation, refund and complaint-handling arrangements.
- Actual processing history and typical transaction sizes, with forecasts clearly identified.
- Current payment platform, gateway and the business problem prompting the inquiry.
- Any unresolved licensing, registration or legal-review question that affects the operating model.
Explain the change you want to make: establishing an eligible route, replacing a platform, accommodating a reviewed billing model or simplifying reconciliation. A specific objective helps distinguish an account question from a legal, software or fulfillment issue. No prior decline is required to begin the discussion.
Which costs and settlement terms need a written answer?
Ask for the complete proposed arrangement after the business has been assessed. Compare processing and gateway charges, recurring-billing costs, refund and dispute handling, minimum commitments, termination terms and support responsibilities. MerchantBridge does not advertise a universal credit repair rate or a guaranteed approval timeline.
Separately establish when captured funds may become available, any conditions affecting disbursement and how adjustments appear in reports. Do not use a proposed payout schedule to justify collecting a consumer fee early. Fee timing under consumer law and settlement timing under the processing agreement answer different questions.
If moving from an existing relationship, identify obligations that continue after the last new charge, including handling prior refunds and complaints. Confirm the new provider's acceptance and integration before promising customers an uninterrupted transition. Any transfer of stored payment data needs the providers' approved process.
What should an ISO include in a credit repair referral?
Discuss an ISO Referral using your own name, firm and contact details. An anonymized business overview can establish whether a more detailed conversation is worthwhile. The first message should identify the operating model and unresolved decision, not deliver a merchant application or consumer records.
- State that the opportunity concerns credit repair and identify any adjacent services.
- Describe the sales channel, including known telemarketing or affiliate involvement.
- Summarize the billing model and whether the merchant has had its timing reviewed.
- Give the operating country, customer-state footprint and approximate activity if known.
- Explain what your current channel cannot accommodate and which capability is needed.
- Flag unknown facts explicitly and agree how permission for a merchant introduction will be obtained.
Do not label the merchant compliant merely because it bills monthly or already has an account. MerchantBridge can explore the referral through relevant relationships, but the partner must assess the facts. Discuss communication, confidentiality and any commercial arrangement case by case before an introduction; no compensation, exclusivity or relationship protection is assumed.
Questions from credit repair merchants and referrers
Does the acquiring relationship mean my business will be accepted?
No. It establishes a category worth discussing. Your services, geography, marketing, billing and other partner requirements still need review.
Can a gateway make an advance fee compliant?
No. Technical ability to charge is separate from permission to charge. The actual service and sales process determine the legal analysis.
Can we describe the business as consulting instead?
Use an accurate description of the actual service. A different label does not resolve credit repair requirements or justify concealing the business from a payment partner.
Do ISOs need to provide their merchant's email immediately?
No. Begin with the referrer's contact information and a business-level brief. Agree the next introduction step before sharing third-party information.
